Terms and Conditions

1. Acceptance & Agreement

By proceeding with this reservation, you (Lessee) agree to be bound by the full terms of this Agreement and acknowledge that this reservation is a binding Quote Request for the dates selected. This request is subject to Lessor’s final approval, contract signing, and payment.

2. Rental Period & Late Penalties

  • Period: The Lessee is responsible for the Equipment from the scheduled Pickup Time until the Return Time.
  • Late Return Fee: Time is of the essence. Equipment returned more than 60 minutes after the scheduled Return Time will be subject to a Late Fee equal to the full Daily Rental Rate for every 24-hour period (or fraction thereof) the Equipment is overdue.
  • Cancellation/No-Show: If the reservation is cancelled less than 48 hours before the pickup time, the reservation deposit (or a minimum fee of one day's rent) may be forfeited. No-shows forfeit the entire deposit/reservation fee.

3. Fees and Security Deposit

  • Pricing: Rates are calculated based on the published tiered structure (Hourly, Daily, Weekly) shown at checkout. Taxes and additional fees (e.g., insurance waiver, if applicable) are added to the total.
  • Security Deposit: A refundable security deposit or credit card authorization hold will be required to finalize the booking. This deposit is held to cover late fees, cleaning charges, or repair/replacement costs resulting from damage.

4. Lessee Liability & Insurance

  • Condition & Risk: Lessee acknowledges the Equipment is received in good, safe, and functional condition. Lessee assumes all risk of loss, damage, theft, or destruction of the Equipment, regardless of cause, from the time of pickup until its return.
  • Damage/Loss: Lessee is strictly liable for the full cost of repair or replacement (at Lessor’s discretion) for any damage to the Equipment resulting from misuse, neglect, or accident.
  • Insurance: Lessee is responsible for ensuring their towing vehicle insurance provides adequate liability and physical damage coverage for the rented trailer. Lessee agrees to indemnify and hold Lessor harmless from all liability arising from the use of the Equipment.

5. Equipment Use & Prohibitions

  • Capacity: The Lessee shall not exceed the stated Maximum Cargo Capacity of the trailer. Overloading is a breach of this Agreement.
  • Towing: Lessee is responsible for verifying their towing vehicle is properly rated and equipped (including correct ball hitch size, lights, and brake controller) to safely tow the Equipment.
  • Prohibited Use: Use of the Equipment for illegal activity, off-road towing, or in a manner that creates excessive wear and tear is strictly forbidden.

6. Maintenance and Return

  • Care: Lessee is responsible for routine checks, including ensuring all lug nuts are tight, tire pressure is correct, and lights are functional before and during use.
  • Return Condition: The Equipment must be returned to the designated 24/7 location clean and free of debris. A cleaning fee may be deducted from the security deposit if the trailer is returned excessively dirty.

7. GPS / TELEMATICS TRACKING DISCLOSURE

The Equipment is equipped with GPS tracking and telematics devices that monitor its location, movement, and operational status. The Lessee hereby consents to the Lessor’s use of this data to: (a) verify compliance with the Prohibited Use section; (b) locate the Equipment in the event of theft, late return, or abandonment; and (c) monitor the Equipment's operational hours. Lessor shall use this information solely for safety, maintenance, and asset protection purposes. Tampering with or disabling the GPS device is a material breach of this Agreement.

8. IMMEDIATE REPORTING OF INCIDENTS

In the event of any malfunction, damage, or accident involving the Equipment, the Lessee must: (a) Immediately cease using the Equipment; (b) Take all reasonable steps to secure the Equipment; and (c) Notify the Lessor immediately by phone at 443-961-7927. In the case of theft or a motor vehicle accident, the Lessee must file a police report within 2 hours and provide a copy to the Lessor. Failure to promptly notify the Lessor may result in the Lessee being held fully liable for all associated costs, including loss of rental income.

9. TOWING VEHICLE REQUIREMENTS AND WARRANTY

The Lessee warrants and certifies that: (a) The towing vehicle has a towing capacity equal to or exceeding the total Gross Vehicle Weight Rating of the trailer; (b) The vehicle's hitch receiver, ball, and wiring are in good working order; and (c) The vehicle is equipped with a functioning trailer brake controller as required by law. The Lessee bears sole responsibility for verifying all towing laws and capacities before hookup.

10. MANDATORY TOWING VEHICLE CERTIFICATION

The Lessee warrants that the information provided in the checkout fields (including Towing Capacity and Brake Controller Type) is accurate and legally complete. The Lessee acknowledges that the Equipment requires a brake controller to be legally and safely towed in the state of Maryland and accepts full, sole liability for any fines, damage, or accidents resulting from inaccurate certification or non-compliant towing equipment.

11. ACKNOWLEDGMENT OF 24/7 PICKUP RISKS

The Lessee acknowledges that this is a 24/7 self-service rental. The Lessee assumes all risk related to the security of the pick-up location and the proper attachment of the trailer to the tow vehicle without direct Lessor supervision. The Lessee agrees that liability for the trailer begins immediately upon unhooking the hitch lock.
